- 형사책임연령 하향조정에 대한 비판적 고찰 : 하향조정 논쟁에 대한 근거 기반을 중심으로 -
국내에서 형사책임연령 하향과 관련한 논쟁이 뜨겁다. 본 연 구의 목적은 사회적, 정치적으로 지속 추진되고 있는 국내의 형 사책임연령 하향조정에 관한 논쟁을 근거에 기반해 비판적으로 고찰하는 것이다. 이를 위해 선행연구, 국회 법안 발의 내용, 소 년범죄 실태, 해외사례 분석을 중심으로 비판적으로 고찰하였으 며, 연구 내용은 다음과 같다. 첫째, 선행연구에서 형사책임연령 하향과 상향 또는 유지 의견이 팽팽히 맞섰으나, 현행 형법상 형 사책임연령은 해외와 비교해 적정하고 하향조정이 필요하지 않 은 것으로 보인다. 둘째, 소년인구 감소 폭보다 소년범죄가 더 높은 비율로 감소하고 있었다. 셋째, 형사책임연령 하향으로 인한 소년범죄 감소 효과는 확인할 수 없었다. 넷째, 소년범죄는 저연령화 되고 있지 않았다. 다섯째, 해외의 소년범죄의 엄벌화 정책을 분석한 결과, 오히려 소년범죄가 증가하는 결과가 나타남 을 확인할 수 있었다. 결과적으로 형사책임연령 하향 조정의 당위성을 얻기 위해 합리적인 근거가 필요함을 확인할 수 있었다. 연구의 한계로 형사책임연령 하향을 저지하는 근거 제시에 집중 되어 있으며, 사회적, 정치적 담론에 맞춘 해법 제시는 못하고 있다. 다만, 본 연구를 통해 형사책임연령 조정과 관련하여 올바른 근거를 제시하는 연구가 확대될 것으로 기대된다.
A Critical Review of the Lowering of the Age of Criminal Responsibility : Focusing on the Evidence Base or the Downgrade Argument
The purpose of this study is to critically examine the debate on lowering the age of criminal responsibility in Korea based on evidence. The research method was based on analysis of previous research, content of proposed bills in the National Assembly, the current state of juvenile crime, and overseas cases. Research results: First, as a result of analyzing previous studies, the age of criminal responsibility under the current criminal law was found to be appropriate compared to overseas. Second, juvenile crime was decreasing at a higher rate than the decrease in the juvenile population. Third, the effect of lowering the age of criminal responsibility on reducing juvenile crime could not be confirmed. Fourth, juvenile crime was not decreasing with age. Fifth, policies to severely punish juvenile crimes overseas have resulted in an increase in juvenile crimes. In conclusion, it is necessary to present reasonable grounds to justify lowering the age of criminal responsibility.
